What is a Will or Testament?

A Will, sometimes known as a Testament or even as a Last Will and Testament is a documents that distributes the assets of the person making the Will (the “Testator”) as specified by the Testator. A will is also used as the instrument in a trust. Generally, any person over the age of majority can draft their own will without the aid of an attorney.

Some Wills contain a self-proving affidavit, which contains the Testator’s acknowledgment and the affidavit of the witnesses, made before a Notary, that all required formalities were observed when the Will was signed.
