Step 10. Getting your Certified Order. After your hearing, if any, the court will certify your Ord, a former spouse, the Bankruptcy Court, or any other party that the court considers appropriate. Step 8. Appear n document explaining what measures you took to try to locate your spouse or co-parent. Have this document notarized and bring it with you to any hearing in your case. However, you must be cautious abhe "Notice of Hearing on Application for Change of Name" in a newspaper of general circulation in the county in which you reside. If you choose to use this publication notice, you must create a writteleted "Affidavit of Service by Certified Mail" to any hearing in your case. If you do not know where your spouse or co-parent lives, at least 14 days before the hearing on your case you must publish tme" to your spouse via certified mail/restricted delivery at least 30 days before the hearing date. The Post Office's card will be returned to you showing delivery. You must bring this card and a compes not agree to your name change, or if you are not sure if he or she agrees to your name change you can send a copy of both your Application and the "Notice of Hearing on Application for Change of Narent sign an "Acceptance of Service" in front of a Notary Public as described in Step 4; you will need to bring that document to any hearing in your case. Alternatively, if your spouse or co-parent doof both your Application and the "Notice of Hearing on Application for Change of Name" in person, and be sure that they note the time and the date on that notice. After that, have your spouse or co-pa you to any hearing in your case. If your spouse or co-parent does not agree to your name change, or if you are not sure if he or she agrees to your name change, you may give them a file-stamped copy tarized, he or she will need to sign the relevant Consent in front of a Notary Public. More information about this notarization process can be found in Step 4, above. In order for this document to be noed copy of both your Application and the "Notice of Hearing on Application for Change of Name," and be sure that they note the time and the date on that notice. Instructions-Name Change Kit 13 Step 7. Notify Your Spouse of Your Name Change and, if necessary, Have Documents Notarized. If yur name change. In some jurisdictions, a hearing may not be required; the court will simply return a signed order to your attention. However, if this is not the case in your area, there may be severale, you can use this number to allow court personnel to assist you more efficiently. The court, either at the time of your filing or shortly thereafter, will set a date and a time for the hearing on yohis is the reference number that you will use for the duration of your time in court. If you have any questions about the status of your name change request, or other specific questions about your castermine the exact amount required. Step 6. The Court Will Assign a Case Number and Will Establish A Hearing Date and Time. The "case number" is the number assigned to your request for a name change. The clerk can return both a file-stamped copy of the forms and, where possible, the signed order. Do not forget to include the filing fee with your documents ­ again, you should contact the court to deorder can be signed without a hearing, that the clerk return the executed order to you in one of the envelopes provided. Include two self-addressed and stamped envelopes with your documents, so that tssary forms and that the judge execute the order. You should also state that, if a hearing is needed, the letter serves as a request to schedule that hearing. Additionally, you should ask that if the include a cover letter that explains that you are requesting a name change and that includes a list of all of the forms that you are submitting. Your letter should request that the court file the necein these jurisdictions. You should contact your local court before going to the courthouse so you will know what forms of payment will be accepted. Mail ­ If you decide to mail your forms, you should e amount that will be due in your jurisdiction. Note that many Arizona courts require either cash, money order, or certified check payments only: personal checks and credit cards will not be accepted to pay the filing fee at the time you bring in your documents, which varies widely between courts. It will probably be between $130 and $230, and you should contact your clerk to determine the precisil the judge has signed your order, as discussed below. You can contact your court in advance to determine where you will need to file the documents, or can ask at the courthouse. You will be required the clerk's instructions and follow them precisely.
