Employment Application

Completing a job application is important for both the employer and the employee, as is it often the first communication between the parties. As such, the employee will want to be sure and put their best foot forward.  The employer will be able to use the application to weed out prospective employees, and use it as a starting point to find out more information.  

It is surprising how much weight a few pages of paper can have in the hiring process. Job seekers can be confused on how they can fill out their application and make it somehow stand out from the rest.  Conversely, what should the employer be looking for when scanning applications?

There are a few universal things that hold true to both employers and job seekers when dealing with a job application:

Is the information accurate?

It is the employers job to screen the information contained in the application. This means that every date and detail should be accurate, and applicants should assume that it will be checked and verified. Employers should verify all information on an employment application.  The Fair Credit Reporting Act sets the standards for employment screening. It is important to note however, that this law governs only background checks by outside agencies, not in-house inquiries. Generally, employers have the right to run credit checks, verify information, obtain credit payment, DMV and criminal records.  The important thing here is that whatever the information, the employer checks should be relevant to the job being applied for.  Also, the employer must notify the applicant that they are conducting a particular inquiry and need to obtain written authorization from the applicant.

There are some records that cannot be checked by an employer under any circumstances. Those include school records (without specific consent by the applicant) and particular areas of criminal records that are prohibited depending on the state where you reside.  Some states limit the depth of inquiry on criminal activity, while others will allow inquiry only for specific job titles. Other information that cannot be reported are bankruptcies after 10 years, civil suits, tax liens, collection

accounts and basically any other negative information that is older than seven years.  Interestingly, these provisions do not apply to a job that has a salary over $75,000. per year.



The employer may not use certain criteria to hire an employee which include sex, race, religion, age, disability, marital status and birthplace. Also, if an employer decides not to hire an employee based on the outcome of a credit check, they must notify the employee in writing and give the employee an opportunity to obtain a copy of their credit report.

What is “at-will” employment?

This employment application states that if the applicant is hired, an “at-will” employment arrangement is created.  Employment “at-will” means that the employer and employee have an arrangement where either party can terminate the agreement at any time, with or without cause.  If an employer opts for this method, it is important that this type of relationship is the same one described in the Employment Agreement and also the Employee Handbook.  Failure to establish this policy in writing will create confusion at the very least, and at is worst, if a dispute arises with an employee, the employer will find themselves at the mercy of the court system.

The employer should be aware if they adopt an at-will employment relationship that there are many exceptions to this rule based on public policy.  Examples of this would be terminating an employee for filing a workers compensation claim, for filing a safety complaint with OSHA, or for serving on a jury.








Step-by-Step Instructions
Employment Agreement

Policy Statement.  Every employer in the United States is required to be an equal opportunity employer.  Under the Equal Opportunity laws, all employers in both public and private sectors are required to provide equal access to jobs and discrimination to employment based on race, gender, ethnicity, disability or age is strictly prohibited.

Applicant should print neatly.  If the employer cannot read the responses it could preclude applicant from getting the job.

 Personal Information.  This section is self-explanatory.  Applicant should fill in name and address, drivers license number and social security number.  The social security number is required not only for future tax filings but also background checks if necessary.

 The applicant will fill in if they are a U.S. citizen, and fill in their visa number if applicable.  

 The applicant will fill in if they have ever been convicted of a crime.  This is a question that is often left blank by applicants.  Leaving the question blank sends up a red flag to the employer that they applicant may have a criminal history. For the applicant, clearly honesty is the best policy. Employers are authorized to ask this question because the employer has the duty of due diligence in the hiring process.  This duty would be violated if the employer hired someone they knew or should have known to be potentially dangerous.  

Complete any information associated with military service if applicable.

 Employment History. The applicant should fill in all relevant information about their most recent or current employer, followed by the two previous jobs in the order of the most recent.  The employer should call each employer and verify the employment information.  Some employers are reluctant to provide any information other than salary and the dates the applicant worked for them.

 Education. Applicant should fill in the pertinent information for each school they attended, the dates, what degree was earned and their major

and special awards earned if any.  Employers may, with the applicants consent only, check the applicants educational background.

 Position Information. Applicant should fill in all pertinent information, taking care to be accurate regarding their skills.  



 Signature Block.  The applicant verifies that all information in the application is true.  It is important to note here that the applicant gives the employer consent to conduct any background checks necessary regarding employment and education history.

This is an “at-will” employment application. This means that either the Employer or Employee can terminate the employment relationship at any time, with or without cause.  It is important for the Employer to be very clear in their intentions creating this type of employment. Also be aware that there are several exceptions to this type of employment relationship which are: breach of implied contract on the part of the Employer, violations of public policy and breach of the implied covenant of good faith and fair dealing.  States vary as to their interpretation of “at-will” employment so it is recommended to check the particular employment laws in your state.
