Ch. 11 ufor renewal under 54 Pa.C.S. § 1114 of a trademark or service mark which was not originally granted under this act shall set forth the appropriate classification under the provisions of 54 Pa.C.S. § 1ainst said petitioner or petitioners. (c) Construction of section -The provisions of this section are hereby declared to be procedural. § 7. Registration of trademark or service mark. An application name, or a certificate in lieu thereof given by a corporation authorized by law to make such searches, showing that there are no judgments or decrees of record or any other matter of like character ag of the county wherein petitioner or petitioners reside and of any other county wherein petitioner or petitioners may have resided within five years of the filing of his or her petition for change of yed for, if at said hearing the petitioner or petitioners shall present to the court proof of publication of said notice as required by the order, together with official searches of the proper offices be heard. If the court be satisfied after said hearing that there is no lawful objection to the granting of the prayer of said petition, a decree may be entered by said court changing the name as pra of a child whose name may be affected by the proceedings. (2) (b) Court hearing and decree - At the hearing of said petition, any person having lawful objection to the change of name may appear and circulation in said county or county contiguous thereto, one of which publications may be in the official paper for the publication of legal notices in said county. Given to any nonpetitioning parentor the hearing thereon, which hearing shall be not less than one month or more than three months after the filing of said petition, and said notice shall be: (1) Published in two newspapers of generalf this section, said spouse shall also be entitled to the benefits hereof. The court shall, thereupon, enter an order directing that notice be given of the filing of said petition and of the day set f or residences for and during five years prior thereto. Divorcing and divorced person may resume prior name. (a) General rule - Any person who is a partarent shall, unless otherwise ordered by the court, thereafter be borne likewise by such minor child. (b) Further change on attaining majority -Any minor child whose surname has been changed pursuant r is made under this chapter changing the surname of anyone who is at the time thereof the parent of a minor child or adopted minor child, then under the care of such parent, the new surname of such p upon receipt of this notice, shall include the change of name information in the central repository as provided for in 18 Pa.C.S.Ch. 91. § 703. Effect on children. (a) General rule - Whenever an ordeState Police and the office of the district attorney of the county in which the person resides when a change of name for a person convicted of a felony has been ordered. The Pennsylvania State Police,his Commonwealth in effect at the time of the commission of that offense or an equivalent crime in another jurisdiction. 3. The court shall notify the Office of the Attorney General, the Pennsylvania 01(a), kidnapping or robbery of a motor vehicle or criminal attempt, criminal conspiracy or criminal solicitation to commit any of the offenses listed above or an equivalent crime under the laws of tult, sexual assault, aggravated indecent assault, robbery as defined in 18 Pa.C.S. § 3701(a)(1)(i), aggravated assault as defined in 18 Pa.C.S. § 2702(a)(1) or (2), arson as defined in 18 Pa.C.S. § 33erson has been pardoned. ii. 2. The court may not order a change of name for a person convicted of murder, voluntary manslaughter, rape, involuntary deviant sexual intercourse, statutory sexual assampletion of a person's sentence and that person is not subject to the probation or parole jurisdiction of any court, county probation agency or the Pennsylvania Board of Probation and Parole; or the pvicted felons ­ 1. The court may order a change of name for a person convicted of a felony, subject to provisions of paragraph (2), if: i. at least two calendar years have elapsed from the date of co changes involving minor children in adoption proceedings pursuant to 23 Pa.C.S. § 2904. A name change involving a minor child whose name is being changed pursuant to section 703. ii. iii. (c) Con5. The procedure in this subsection shall not apply to proceedings involving: i. An election to resume a prior surname pursuant to section 704 (relating to divorced person may resume prior name). Nametroy the fingerprints. ii. 4. Within 60 days of receipt of the material under paragraph (1), the Pennsylvania State Police shall certify to the court what action has been taken under paragraph (3). After you have received your certified order, you may amend your personal documents to reflect your name change. This may take some time, so be patient! A list of agencie your Name Change Order. This is the final official step of the name change process. Contact your local court to obtain a certified copy of this order, which will cost about $5 per copy. Step 12. If there is a hearing, be sure that you know where the courtroom e date and content of your notice. Bring these documents to your hearing; be sure to make copies of these documents for your records as well. Step 9. Attend Hearing, if necessary. You should contact yn. After the designated newspapers have published the notices of your hearing date, each newspaper will send you either an affidavit or other proof of publication, i.e., a certificate that confirms th there are alternate certificates that may suffice. You must take either a copy of either an official search or a certification to your hearing. Step 8. Receive your Affidavits or Proofs of Publicatiocation shows the existence of any recorded mortgages in your current name. You should contact your local Recorder of Deeds to determine if such a certification is available in your jurisdiction, or ifor decrees of record against you. For example, one could show that there are no judgments or decrees against him by obtaining a Name Change Certification from his local Recorder of Deeds. This certifiof any other county in which you resided in the five years preceding your filing, or a certificate from an authorized corporation in lieu of these searches, which show that there aren't any judgments ep 7. Obtain a Name Change Certification from the Recorder of Deeds. Under Pennsylvania law, you are required to have either official searches of the county in which you reside, and official searches ng, contact the clerk of your local court to explain your situation. They may require additional information from you, and you should make every effort to comply with their additional instructions. Be certain to make a note of the time and date; most courts will not send a reminder, and you will ner for Publication to you at this time. You should carefully review this Order, which will have all of its remaining blanks filled in, including the date on which you will be required to appear in courout the status of your name change request, or other specific questions about your case, you can use this number to allow court personnel to assist you more efficiently. The court will return the Orde to you. The "file number" is the number assigned to your request for a name change. This is the reference number that you will use for the duration of your time in court. If you have any questions ab, so that the clerk can return both a file-stamped copy of the forms and, where possible, a signed order. Step 6. The court will assign a file number, establish a file and return Order for Publicationorders can be signed without a hearing, that the clerk return that executed order to you in one of the envelopes provided. Include at least two self-addressed and stamped envelopes with your documents that the judge execute the order. You should also state that, if a hearing is needed, the letter serves as a request to schedule that hearing. Additionally, you should ask that if one or both of the letter that explains that you are requesting a name change and that includes a list of all of the forms that you are submitting. Your letter should request that the court file the necessary forms and required to pay the filing fee at the time you bring in your documents, which will be about $100.
