q   The rental application should be signed by the prospective Tenant and by any spouse that will be residing on the premises.

q   If a second adult will be renting the premises, they should complete a separate rental application form.

q   The Landlord should perform a thorough investigation of the prospective Tenant (and Tenants spouse) based on the information provided in the Application. Landlord should keep copies of any correspondence relating to the Application and written notes of any telephone conversations with and relating to the prospective Tenant(s).

q   It is a good idea to request some form of identification (i.e. drivers license, passport, etc.) from the applicant after the application is completed.

q   Landlord should make sure that all the information provided by the prospective Tenant(s) “makes sense” and that everything matches (i.e. drivers license information matches information on application, etc.)

q   The Landlord should keep the original Application.

q   A copy of the Application may be provided to the prospective Tenant.

q   If an Applicant does not meet Landlords criteria, Landlord should document the reason for the decision. Decisions to reject an Application should be made in good faith and for legitimate legal purposes.

q   Laws vary from time to time and from state to state.  In many states there are specific laws regarding the disclosure of personal information such as employment records, financial and credit records. General Information
Residential Rental Application

A Residential Rental Application allows a landlord to obtain information from prospective tenants interested in renting a residential property. Basic information, including prior rental history, employment and credit related information is requested through this application from the potential tenant. The Application allows the prospective tenant to consent to a credit and background check by the Landlord. The prospective Tenant also verifies that the information provided is true and correct.

It is vitally important for the Landlord to thoroughly screen all prospective tenants, checking credit history, references and background. Part of a good screening process is using a good comprehensive rental application, and following up and checking the information the prospective tenant gives you.  The information gathered through this application will be useful for the Landlord in making a decision as to whether to rent the premises to the prospective tenant or not.

Before choosing a tenant, the Landlord should check with the perspective tenants previous Landlords and call any references that the tenant provided.  Obtaining a credit report is particularly valuable because it will tell you if the prospective tenant has a good credit history, if they have a history of paying their bills on the time and have ever filed bankruptcy. If you determine that you do not want to rent to a particular tenant because of an adverse credit report, the Landlord must send the applicant an “adverse action” letter. This letter should inform the applicant the reason they were rejected, the name of the credit agency used, and inform the applicant that they are entitled to a copy of the report by requesting it from the agency. To avoid any legal problems, it is important for the Landlord be fair and even-handed in the screening of all applicants.

Landlords should not discriminate against any Applicant on any illegal or unlawful basis, including race, color, religion, sex, national origin, age, disability, family status or any other basis prohibited by local or state laws. Such discrimination as the sole basis of refusal to rent is illegal throughout the United States.  

As a Landlord it is important to remember that there is a legal obligation to keep the premises safe and in good repair.  These laws are in virtually every state, and are created to ensure that rental properties meet a minimum








standard of health and safety.  Failure to take care of repairs or address environmental hazards can have dire consequences for the Landlord.

Another popular area of inquiry for the Landlord is how much of a security deposit can they require from the tenant. Many states limit the amount a Landlord can charge (usually no more than two months rent), so its a good idea to check with your own states rules. Some states also have specific requirement as to how the deposit is handled after it had been received, such as depositing the in a separate interest bearing account. The proper use of the security deposit should only be for unpaid rent, or to address wear and tear specifically caused by the tenant.

Step-by-Step Instructions
Rental Application

The following instructions will guide the user through each section of the Rental Application so that all terms are fully understood.

Introduction: Landlord should complete this section, filling out the name of the individual or company that is acting as the Landlord to the rental property. Fill in the complete street address of the property, the date that you want the prospective Tenant to move in, and the length of the desired occupancy.

Applicant Information: The Tenant will fill in their full name, date of birth, social security number and drivers license number. The social security number is important, because you will need it to do a credit check on your applicant. Its a good idea to physically inspect the drivers license or obtain a copy for your files; this way you can verify that the applicant is in fact the same person as on the license and over 18 years of age.

Rental History: The Tenant will complete this portion, listing the basic information about their current living arrangement, including their current Landlords name and phone number. In the space below, the Tenant will list the same information to their home previous to that.  It is important for the Landlord to call and check their past history. Valuable information can be gathered by speaking to the applicants past landlords.

Spousal Information:  Applicant will fill in all identifying information of their spouse, if applicable.

Vehicles: Applicant will fill in type of vehicle(s) they own and their license numbers.

Pets:  The applicant will fill in the name, type of breed and size of the pet(s). Whether a Landlord accepts pets is at the discretion of the Landlord.  Many Landlords decide to allow pets because they are animal lovers themselves, and it broadens their base of potential renters.  The risks allowing pets are additional wear and tear to your rental and possible neighbor complaints.  Some Landlord who accept pets charge an additional fee and add it on to the security deposit.  Check your state and local rules however, because this practice is not legal in all states.

Miscellaneous:  The applicant will fill miscellaneous information here; whether they have a waterbed, are they a smoker, do they own real estate and have they ever been evicted. They will also need to disclose if they have ever intentionally







refused to pay rent, and if they have ever been convicted of a felony.  It is good
for the Landlord to be aware of what types of discrimination are illegal when selecting a tenant.  It is illegal to reject an applicant based on race, religion, ethnicity, sex, because the applicant has children, or disability.  

Current Employer: The applicant will fill in information about their current employer, who they are, how long they have worked there, and their annual income. The Landlord should absolutely call and speak with the applicants employer, verify income and get a sense if the person responsible.

Spouses Employer: The applicant will complete the same as above for their spouse. Again Landlord should contact the employer and verify all income information.  The longer they have worked there should help to assure the Landlord that the applicant(s) have a steady, reliable income and will be able to make their rent payments.

Nearest Relative Not Living with you:  The applicant will fill in information of a relative that can be used as a reference and called in case of emergency.  This reference may be a bit biased; most family members would be reluctant to give a negative reference.  Nonetheless the Landlord should follow up on every reference to get the most complete picture possible of the applicant.

Credit/Personal References:  The applicant will complete the contact information for credit and/or personal references. As with all references, Landlord should call and follow up to gather information. While these references are informative, they arent fool proof.  Remember that the applicant has picked what references they felt comfortable giving you.

Bank References:  Applicant will fill in their bank information. Usually without a signed statement by the applicant, it will be difficult to get any specifics about the applicants account.  You may be able to confirm however that they do in fact have an account there.  If the applicant does not have a bank account, this would be a red flag to Landlord.  If that is the case, the Landlord should specify how they would like their rent paid, by cashiers check, for instance.

Credit Cards: The applicant will fill in information for four different credit cards. As with the bank, the credit card companies will not be able to give you any specific information about the applicants account. It will however give the Landlord a sense of what kind of debt the applicant may be carrying.  The credit card information can be verified by the credit report that you would get on the applicant.

A credit check on the applicant is a must.  There is usually a small fee ($25.00)








associated with this, which is often charged to the applicant.  There are a variety of businesses that can do this, or you can contact the credit agencies
directly, such as Experian, who will provide a three-credit bureau report.  If
you use an agency, they will be able to assist in conducting a criminal background check as well.

Signature Block: Make sure that the applicants have read the preceding paragraphs. By singing the application they are authorizing the Landlord to conduct a background check on the applicant. Have the applicant sign and date the form. Keep the original and provide the applicant with a copy.
