This lease agreement is for a salon owner to use when leasing out a station in the salon. It is important that both parties know their rights when entering into any agreement concerning land. Salon Station Lease Agreement

I, (name of salon owner)__________________________________, (hereinafter referred to as LESSOR) a resident of (County, State)______________________ agree to lease a salon station, as described and defined below, to (name of station renter) _________________________________________ (hereinafter referred to as LESSEE) a resident of (County, State)______________________ under the follow terms and conditions:

1.   Leased Premises; Term of Lease, etc.:

1.1   LEASED PREMISES. This lease relates to the station on the premises located at (insert street and unit address, city, County and State) ____________________________________________________________ and will consist of (insert sufficient description of station and amenities i.e. station number etc.) _______________________________________________________________________
_______________________________________________________________________ ( hereinafter referred to as STATION). Said premises to be occupied and operated as a business open to the public.

1.2   TERM OF LEASE. This lease shall have a (insert length of lease) ______ term commencing on (insert starting date)________________ and expiring on (insert ending date) ___________________. Should LESSEE continue in possession of the station after expiration of the lease, the RENEWAL TERM provision shall govern.

1.3   RENEWAL TERM. LESSEE shall have the right, exercisable as hereinafter provided, to extend the term of this Lease for one successive period of one year (the “Renewal Term”) upon the same covenants, terms and conditions as those provided in the Lease for the Lease Term.  If LESSEE desires to preserve the right to extend the Lease Term for a Renewal Term, LESSEE shall give LESSOR a notice no later than 30 days before the end of the Lease Term. Absent notice, the term of the lease shall extend for successive one month periods upon the same covenants, terms and conditions as those provided in the Lease for the Lease Term.

2.   Rental; Payments; Late Fees, etc.:

2.1   RENTAL. LESSEE agrees to pay LESSOR as rent for the STATION the amount of $________ (hereinafter referred to as “Rent”) each month in advance of the first day of each moth. The Rent, and all other sums payable by LESSEE to LESSOR under this Lease, shall be payable in lawful money of the United States of America and shall be paid to LESSOR at the Premises or such other place as designated by the LESSOR.

2.2   MANNER OF PAYMENT. Payment of rent shall be paid by the LESSEE to LESSOR at (insert name of salon) _______________________________. Any other place for payment shall be designated in writing between LESSOR and LESSEE.

2.3   LATE FEES. If any amounts due under the Lease are more than _____ days late, LESSEE agrees to pay a late fee of $_______.   

2.4   INSUFFICIENT FUNDS. LESSEE agrees to pay the charge of $_______ for each check provided by LESSEE to LESSOR that is returned to LESSOR for lack of sufficient funds.

3.   Security Deposit; Return:

3.1   SECURITY DEPOSIT. On execution of this Lease, LESSEE shall deposit with LESSOR, in trust, a security deposit of $__________ (the “Deposit”), as security for the performance of LESSEEs obligations under this Lease.  LESSOR may (but shall have no obligation to) use the Deposit or any part thereof to cure any breach or default of LESSEE under this Lease, or to compensate LESSOR for any damage as it incurs as a result of LESSEEs failure to perform any of LESSEEs obligations hereunder.  LESSOR is not limited to the Deposit to recoup damage costs, and LESSEE remains liable for any balance. LESSEE shall not apply or deduct any portion of the Deposit from any months rent, including the last month of the rental term. LESSEE shall not use or apply the Deposit in lieu of payment of Rent. If LESSEE breaches any terms or conditions of this Lease, LESSEE shall forfeit the Deposit, as permitted by law.

3.2   RETURN OF DEPOSIT.  In the event that LESSEE shall fully and faithfully comply with all of the terms, provisions, covenants and conditions of this Lease, the Deposit shall be returned to LESSEE after the date fixed as the end of the Lease and after delivery of entire possession of the Premises to LESSOR.

4.0   EVENT OF DEFAULT.  If LESSEE defaults in fulfilling any of the covenants of this Lease, LESSEE shall be in default of this Lease.  Then, in any one or more of such events, subject to any statute, ordinance or law to the contrary, and upon LESSOR serving a written seven (7) days notice upon LESSEE specifying the nature of said default and upon the expiration of said seven (7) days, if LESSEE does not cure a default of which he has been notified, or if the default cannot be completely cured or remedied in seven days, LESSOR may at LESSORs option: (i) cure such default and add the cost of such cure to LESSEEs financial obligations under the Lease; or (ii) declare LESSEE in default and terminate the Lease.  

5.0   EQUIPMENT. LESSOR agrees to provide (insert description of equipment provided as part of lease) __________________________________________________

6.   Maintenance; Utilities; and Taxes
6.1   LESSEE TO MAINTAIN STATION.  LESSEE agrees to at all times keep and maintain the station area in a clean and professional condition. LESSEE, at own expense, shall promptly repair any damage to the station caused by any act or omission of LESSEE or any agent, employee, customer, guest or invitee of LESSEE.  Any structural changes must have prior written consent of LESSOR. At the end of lease, LESSEE covenants to return station in as good condition as at the beginning at the term of this lease, ordinary wear and tear excepted.
DAMAGES TO OR DESTRUCTION OF PREMISES.  Partial or total destruction of the premises by fire or other hazard shall be repaired and/or restored to substantially the same pre-damage condition by the LESSOR. Should the premises be rendered be completely destroyed , HOWEVER, in the event the premises are completely destroyed or are so damaged that they cannot reasonably be used by LESSEE, then this lease may be terminated by LESSOR by serving written notice of such termination upon LESSEE.
6.2   UTILITIES. LESSOR agrees to pay for and provide water, electricity, telephone and heat for the property.
6.3   TAXES. LESSOR shall be responsible for all taxes in relation to the premises.
7.0   ASSIGNMENT AND SUBLETTING. LESSEE expressly covenants that it shall not assign or sublease any interest in this Lease without prior written consent of the LESSOR. Any assignment or sublease without LESSORs written prior consent shall, at LESSORs option, terminate this Lease. No assignment, underletting, occupancy or collection shall be deemed a waiver of the provisions of this Lease, the acceptance of the assignee, under LESSEE or occupant as, or a release of LESSEE from the further performance by LESSEE of covenants on the part of LESSEE in this Lease.
8.0   NOTICE. Where, in this lease notice or demand is required. Such notice or demand shall be given or served by writing, deposited in the United States Mail, with appropriate postage to the following addresses:
