Notice of Termination of Month-to-Month Lease

If it becomes necessary for a Landlord to notify a Tenant that a month-to-month tenancy is being terminated, the notice should be in writing. This is not only a good idea, but it also often required by law and/or by the lease. Generally, month-to-month are created either by a month-to-month lease, if the tenant is occupying the premises without a lease or if the tenant still occupies the premises after the expiration of a written lease (i.e. a one year lease).

This form can be used by a Landlord to give notice of termination of a month-to-month tenancy to a Tenant.

The notice requirements vary from state to state (i.e. how long before the termination date and in what manner the notice must be given).

Please be sure that you have vacated the Premises and removed all of your personal property by the termination date.  Further, please be sure that the Premises are surrendered clean and in the same condition as when your occupancy commenced, reasonable wear and tear excepted.  All keys, access cards and similar items must also be returned by the termination date.  Please be further advised that you remain responsible for the payment of rent through the termination date.
