This Codicil, an amendment to a Will, describes the care the person making the Will (the "Testator") wants taken with regard to his or her animals. This Codicil does not avoid probate for the Testator's estate. It merely directs how the animals the Testator owns will be provided for when the Testator passes. This form is to be used in conjunction with a pre-existing, and valid, will.

DO NOT SIGN YOUR CODICIL UNTIL YOU HAVE READ THESE INSTRUCTIONS!

   Once your codicil is properly formatted, you must have the necessary witnesses and Notary Public present before you sign the Codicil. The legal requirements to properly execute a Codicil are the same as those to execute a Will; follow them carefully to ensure your Codicil has the same power of disposition of property as your will. To properly execute your Codicil follow these steps:

1.   Select three (3) witnesses to assist you by witnessing your execution of the Codicil. These persons:

a.   Must be Adults

b.   Not mentioned in the will/codicil either as a beneficiary, executor, trustee, or guardian

c.   Can be friends, neighbors, co-workers, or even strangers

d.   May be called upon to testify in court someday should a dispute over a disposition arise

2.   Have all of the witnesses meet at the office or home of a local Notary Public.

In the presence of the witnesses and the Notary Public:

3.   Sign the Codicil in ink, in the place marked at the end of the Codicil.

4.   Initial the bottom of each page of the codicil in the place provided.

5.   Have the first witness sign and print their name and fill in their address in the space provided.

6.    

Have the second witness sign and print their name and fill in their address in the space provided.

7.    

Have the third witness sign and print their name and fill in their address in the space provided.

8.   Have the Notary Public complete the Notary Acknowledgment section of the codicil.



Once these steps are carefully followed, your Codicil becomes a valid legal document. Keep the Codicil in a safe place, generally with the Will.

Any expenses incurred for this care (including the costs of veterinary services and transportation) shall be charged against the principal of my residuary estate. Following such consultation, I direct my Personal Representative to place any and all of my animals in a private, non-institutionalized setting (individual or family) where such animals will be cared for in a responsible manner. I intend that my Personal Representative have the broadest possible discretion to carry out the purposes of this Article ____________.

I give my animal(s) alive at the time of death to [NAME OF CARETAKER] _______________________________________ along with the sum of $_________ to be used for the care of my animal(s) during their lifetime. This gift will lapse if no animal(s) is living at the time of death. Any money remaining after the death of my animal shall be returned to my residuary estate. Should [NAME OF CARETAKER] not wish to receive my animal(s), I direct my Personal Representative to place my animal(s) in a private, non-institutionalized setting (individual or family) where such animals will be cared for in a manner that any responsible, devoted pet owner would give his or her pets.




I intend my Last Will and Testament to be modified by this Codicil only with regard to the provisions herein described. I sign this Codicil, consisting of ______ pages, this date ____________, freely, for the purposes expressed, under no constraint or undue influence, and declare that I am of sound mind
