Frequently Asked Questions

A marital settlement agreement is a legal document that outlines the terms of a couple's separation, including property division, alimony, and other financial responsibilities. It serves to clarify each party's rights and duties, helping to prevent future conflicts.

This form is designed for use in Arkansas but can be adapted for use in other states, except Louisiana. However, it's essential to consult local laws to ensure compliance with state-specific requirements.

This particular kit is specifically tailored for couples without children. If children are involved, a different form that addresses child custody and support would be necessary.

While legal representation is not required to complete this form, it is highly recommended. Consulting with an attorney can ensure that your rights are fully protected and that the agreement complies with state laws.

If there are disagreements on specific terms, it may be beneficial to engage in mediation or negotiation before finalizing the agreement. Open communication and compromise can help both parties reach a satisfactory resolution.

Is This Form Right For You?

Use This Form If:

  • Individuals who are going through a divorce without children may find this marital settlement agreement essential for outlining their rights and responsibilities. By clearly defining property division and debt management, both parties can avoid future disputes and ensure a smoother transition post-divorce.
  • Couples seeking to amicably separate can utilize this form to create a legally binding agreement that covers all necessary aspects of their separation. This agreement helps in establishing clear expectations regarding alimony and insurance, which can alleviate stress during an emotionally challenging time.
  • For those who wish to formalize their separation before finalizing a divorce, this kit provides a comprehensive framework that can be integrated into a divorce decree. It serves as a proactive measure to prevent misunderstandings and conflicts over shared assets and obligations.
  • Situations requiring a clear delineation of financial responsibilities often benefit from this marital settlement agreement. By addressing issues like property division and debt handling upfront, couples can foster a cooperative environment that minimizes conflict.
  • This form is particularly useful for couples who have already reached an agreement on the terms of their separation but need a structured document to formalize their understanding. Having a completed sample agreement as a reference can guide them in drafting their own tailored settlement.

Do Not Use If:

  • โ€“ This form is not appropriate for couples with children, as it does not address child custody, visitation, or child support issues. In such cases, a different agreement tailored to the needs of children is necessary.
  • โ€“ If there are significant disputes regarding property or financial obligations, this form may not suffice. In situations where negotiations are contentious, legal counsel or mediation may be required to reach an agreement.
  • โ€“ Couples who have already filed for divorce and are in the midst of court proceedings should avoid using this form. Instead, they should work with their attorney to ensure that all legal requirements are met through the court system.
  • โ€“ This kit is not suitable for individuals seeking a prenuptial or postnuptial agreement, as it is specifically designed for marital separation. Different forms and legal considerations apply to those agreements.
  • โ€“ If one party is not willing to cooperate or engage in the separation process, this form may not be effective. A lack of mutual agreement can lead to complications that require legal intervention.

Alimony & Support Laws - Arkansas

Alimony/Maintenance/Spousal Support: Alimony may be granted to either spouse in fixed installments for a specific period of time and subject to automatic termination upon the death of either spouse, remarriage of the receiving spouse, or the establishment by the receiving spouse of a relationship that produces a child or children. Where the grounds for divorce are voluntary separation for 3 years, fault may be considered in dividing the property. The factors for consideration specified in the statute are that the amount be reasonable based on the circumstances of the parties and the nature of the case. Alimony payments may be ordered to be paid through the registry of the court. [Arkansas Code of 1987 Annotated; Title 9, Chapter 12-312].
