This Hawaii Will with Trust is for use by a married person (husband or wife) with minor children and includes a self-proved affidavit. It distributes the assets of the Testator (i.e. person making the Will) to the spouse if he/she survives the Testator, otherwise the assets will go to the children. If the children are minors at the time of the Testator’s death and the spouse has pre-deceased the Testator, the Will allows the appointment of a Guardian for any minor child(ren) and a Trustee to administer the minor children’s assets. The Will also creates a Trust for any minor child(ren). The Will also allows the Testator to make specific gifts to others as well. This Will is suitable for estates worth less than $1,000,000.

Frequently Asked Questions

A mutual will is a legal document created by two parties, typically spouses, that outlines how their assets will be distributed upon their deaths. It is designed to ensure that both parties' wishes are honored and can provide clarity in estate planning.

This will allows for the appointment of a guardian for minor children in the event that both parents pass away. It also establishes a trust to manage the children's assets until they reach adulthood, ensuring their financial security.

Yes, you can make changes to your will at any time, provided you follow the legal requirements for amending a will in Hawaii. This may involve creating a new will or drafting a codicil, which is an amendment to the existing will.

If your spouse pre-deceases you, the will specifies that your assets will be distributed to your minor children. This ensures that your children are taken care of and receive their inheritance as intended.

This will is designed for estates valued at less than $1,000,000. If your estate exceeds this amount, you may need to consider more complex estate planning strategies to address tax implications and asset distribution.

Is This Form Right For You?

Use This Form If:

  • Individuals who are married and have minor children may need this form to ensure that their assets are distributed according to their wishes in the event of their death. This will provides a clear plan for asset distribution, prioritizing the spouse and then the children, which can help avoid family disputes.
  • Situations requiring the appointment of a guardian for minor children can be addressed with this will. If both parents pass away, this document allows for the selection of a trusted individual to care for the children, ensuring their well-being and stability during a difficult time.
  • For those with a combined estate worth less than $1,000,000, this will is specifically designed to meet their needs. It simplifies the estate planning process while providing necessary legal protections for the family, making it an ideal choice for smaller estates.
  • Couples looking to make specific gifts to family members or friends can utilize this will to outline their wishes clearly. This feature allows for personal touches in the estate plan, ensuring that sentimental items or financial gifts are distributed as intended.
  • Parents who want to create a trust for their minor children will find this will beneficial. It establishes a framework for managing the children's inheritance until they reach adulthood, providing financial security and oversight.

Do Not Use If:

  • This form is not appropriate for individuals without minor children, as it specifically addresses the needs of married couples with dependents. If there are no children involved, a standard will may suffice.
  • For those with estates exceeding $1,000,000, this will may not provide the necessary legal protections and tax considerations required for larger estates. In such cases, consulting with an estate planning attorney is advisable.
  • If a couple has complex family dynamics, such as children from previous marriages, this mutual will may not adequately address all parties' interests. A more tailored estate plan could be necessary to avoid potential conflicts.
  • In situations where one spouse has significant debts or liabilities, this will may not be the best option. It is essential to consider how debts will affect the estate and whether additional legal protections are needed.
  • This form should not be used if the couple wishes to create separate wills. A mutual will binds both parties to the terms, which may not be suitable for couples who want individual control over their estates.
