  • Situations requiring a clear understanding of property ownership can benefit from this kit. For example, couples who have accumulated various assets over the course of their marriage will need to compile a comprehensive inventory to facilitate negotiations and finalize their divorce.
  • To comply with Missouri's legal requirements for property division, this kit provides the necessary documentation and guidance. It helps individuals prepare for discussions with their attorneys and ensures that they are aware of all factors that may influence the division of their assets.
  • For those who may believe they have no property to divide, this kit serves as a precautionary measure. Completing the forms can reveal overlooked assets or debts that need to be addressed in the marital settlement agreement, preventing future disputes.
  • Couples considering a separation may use this kit to outline their property situation before initiating formal divorce proceedings. This proactive approach can lead to more amicable negotiations and a clearer understanding of each party's financial standing.

Do Not Use If:

  • – This form is not appropriate for individuals who are not legally married or are in a common-law marriage, as the property division laws may differ significantly. Without a legal marriage, the forms may not apply.
  • – If there are ongoing disputes regarding child custody or spousal support, it may be more beneficial to focus on those issues first before addressing property division. Resolving these matters can impact how property is divided.
  • – In cases where one party has significant legal representation and the other does not, using this kit without legal advice may lead to an imbalance in negotiations. It is advisable to consult an attorney in such situations.
  • – If the couple has a prenuptial or postnuptial agreement that outlines property division, this kit may not be necessary. The existing agreements should be followed instead of using these worksheets.
  • – For individuals who have already reached a final divorce settlement, this kit is not needed as the property division has already been legally established.

Property Division Laws - Missouri

Property Distribution: Missouri is an “equitable distribution” state. Each spouse retains his or her separate property obtained prior to the marriage, including any gifts or inheritances. In addition, any property exchanged for separate property or interest obtained from holding separate property remains as separate. Commingled property does not become marital solely by virtue of the act of commingling. Marital property (all property acquired after the marriage whether held jointly or individually, except if: [1] gift or inheritance; [2] received in exchange for non-marital property; [3] an increase in non-marital property; or [4] property excluded by a written agreement between the spouses) is divided after a consideration of the following factors: [1] the contribution of each spouse to the acquisition of the marital property, including the contribution of each spouse as homemaker; [2] the value of each spouse’s property; [3] the economic circumstances of each spouse at the time the division of property is to become effective; [4] the conduct of the spouses during the marriage generally and as it relates to the disposition of their property; [5] the desirability of awarding the family home to the spouse having custody of the children; and [6] any custodial arrangements for children. [Annotated Missouri Statutes; Title 30, Chapter 452, Section 330 and Missouri Case Law].
