Is This Form Right For You?

Use This Form If:

  • Individuals who are going through a divorce may find this kit essential for organizing their assets. By completing the worksheets, they can ensure that all property is accounted for, which is crucial for a fair settlement.
  • Situations requiring a clear understanding of property ownership can benefit from this kit. It helps couples identify and document all marital assets, which is necessary for equitable distribution during divorce negotiations.
  • To comply with Montana state laws regarding property division, this kit provides the necessary forms and guidance. It ensures that individuals are aware of their rights and obligations when dividing property in a divorce.
  • For those who feel they have minimal assets, this kit is still valuable. It encourages thorough documentation of all property, preventing any oversight that could affect the marital settlement agreement.
  • Couples looking to negotiate their property division amicably can use this kit as a starting point. The worksheets facilitate discussions about asset valuation and division, promoting transparency and cooperation.

Do Not Use If:

  • This form is not appropriate for individuals who are not undergoing a divorce or legal separation. The worksheets are specifically tailored for property division in marital contexts and may not apply to other situations.
  • If you have already finalized your divorce and signed a settlement agreement, this kit is unnecessary. The forms are intended for use during the negotiation phase and not after agreements have been made.
  • Individuals with significant legal complexities, such as business ownership or extensive investments, should seek professional legal advice rather than relying solely on this kit. The worksheets may not adequately address all legal nuances.
  • For those who are in a pre-marital or post-marital agreement situation, this kit may not be suitable. Specific agreements may have their own requirements that differ from standard property division processes.

Property Division Laws - Montana

Property Distribution: Montana is an “equitable distribution” state. All of the spouse’s property, including any held prior to the marriage and any gifts and inheritances, is divided by the court, without regard to marital misconduct, based on consideration of the following factors: (1) the contribution of each spouse to the acquisition of the marital property, including the contribution of each spouse as homemaker; (2) the length of the marriage; (3) the age and health of the spouses; (4) the occupation of the spouses; (5) the amount and sources of income of the spouses; (6) the vocational skills of the spouses; (7) the employability of the spouses; (8) the liabilities and needs of each spouse and the opportunity of each for further acquisition of capital assets and income; (9) the time necessary for a spouse to acquire sufficient education to enable the spouse to find appropriate employment; (10) any premarital agreement; (11) any prior marriage of each spouse; (12) whether the property award is instead of or in addition to maintenance; and (13) any custodial provisions for the children. [Montana Code Annotated; Section 40, Title 4-202].
