This Nebraska Will with Trust is for use by a married person (husband or wife) with minor children and includes a self-proved affidavit. It distributes the assets of the Testator (i.e. person making the Will) to the spouse if he/she survives the Testator, otherwise the assets will go to the children. If the children are minors at the time of the Testator’s death and the spouse has pre-deceased the Testator, the Will allows the appointment of a Guardian for any minor child(ren) and a Trustee to administer the minor children’s assets. The Will also creates a Trust for any minor child(ren). The Will also allows the Testator to make specific gifts to others as well. This Will is suitable for estates worth less than $1,000,000.

Is This Form Right For You?

Use This Form If:

  • Individuals who are married and have minor children often need a mutual will to ensure that their assets are distributed according to their wishes in the event of their death. This document provides peace of mind by outlining the distribution of assets to the surviving spouse or directly to the children if both parents pass away.
  • Situations requiring the appointment of a guardian for minor children can be addressed with this mutual will. Parents can specify who they would like to take care of their children in the event of their untimely death, ensuring that their children are raised by someone they trust.
  • For those with estates valued under $1,000,000, this mutual will is a cost-effective solution for estate planning. It simplifies the process of asset distribution and minimizes the potential for disputes among heirs.
  • Couples looking to make specific gifts to family members or friends can utilize this will to clearly outline their intentions. This ensures that their wishes are legally documented and can be executed as intended.
  • In cases where one spouse pre-deceases the other, this will provides a clear framework for asset management and distribution. It allows the surviving spouse to focus on their grief without the added stress of navigating complex estate issues.

Do Not Use If:

  • This form is not appropriate for individuals who do not have minor children, as it is specifically designed to address the needs of married couples with dependent children. Without minor children, the provisions regarding guardianship and trusts become irrelevant.
  • If the estate is valued at more than $1,000,000, this mutual will may not adequately address the complexities of estate tax and distribution. In such cases, individuals should seek more comprehensive estate planning solutions.
  • Couples who have significant assets in multiple states may find this will insufficient due to varying state laws regarding wills and trusts. It is advisable to consult with an attorney who specializes in multi-state estate planning.
  • For those with complex family dynamics, such as blended families or estranged relationships, this form may not capture the nuances required for equitable asset distribution. A tailored estate plan may be necessary.
  • If either spouse has substantial debts or liabilities, this will may not provide adequate protection for the surviving spouse or children. Consulting a financial advisor or attorney is recommended to address these concerns.
