Is This Form Right For You?
Use This Form If:
- Individuals seeking to end their marriage without children will need to file this petition to formally request a divorce from the court. This document outlines the necessary details and allegations, ensuring that the legal process is initiated correctly.
- Couples who have mutually agreed to divorce and do not have any dependents may find this form essential for expediting their divorce proceedings. By using this petition, they can simplify the process and avoid unnecessary complications related to child custody.
- In situations where one spouse is not contesting the divorce, this petition serves as a straightforward way to document the request for dissolution. It allows the filing spouse to present their case clearly and request the court to grant the divorce without the need for extensive litigation.
- For those who may be unfamiliar with legal procedures, this attorney-prepared packet provides guidance and necessary forms to ensure compliance with New Mexico laws. It is particularly useful for individuals who want to navigate the divorce process with clarity and confidence.
- Situations requiring a formal legal separation can also benefit from this petition. Even if the couple is not ready to finalize the divorce, this document can initiate the legal process and establish a timeline for separation.
Do Not Use If:
- – This form is not appropriate for couples who have children, as it does not address child custody or support issues. In such cases, a different form that includes provisions for children is necessary.
- – If one spouse contests the divorce, this petition may not be suitable. In contested divorces, additional legal procedures and documentation are required to address disputes between the parties.
- – Couples who have significant marital assets or complex financial situations should consider consulting an attorney before using this form. The petition does not cover property division or spousal support, which may require more detailed legal attention.
- – This form is not intended for individuals seeking legal separation instead of divorce. Those looking for a legal separation should use a different form that specifically addresses that process.
- – If there are allegations of domestic violence or abuse, it is crucial to seek legal advice and potentially use different legal remedies that prioritize safety and protection.
