Registration is mandatory. The
applicant must register electronically
with the Office of the Secretary of
State or with the office of the Register
of Deeds in each county where the
person intends to conduct business.

Registration application requirements:
The applicant must file a statement
before the person intends to conduct
business. The statement must contain
the name of the owner(s), the post office
address of the owner(s), the residence
address of the owner(s), and the address
where the principal place of business is
located. (37-11-1).
Publication requirements: The applicant
is not required to publish the
fictitious name. However, the Register
of Deeds does have the fictitious name
published. (Section 37-11-1).
Office for registration: The applicant
must register with the office of the Register
of Deeds in each county where the
person intends to conduct business or
electronically on the Secretary of State
