What is a Postnuptial Agreement?

A Postnuptial Agreement is a voluntary contract between a husband and wife entered after marriage, which determines how property will be disposed of in the event of a divorce or death. They can be used when no prenuptial was entered into or to cover situations that were not dealt with in a prenuptial – such as career change, children, inheritance etc. Postnuptials can also cover what is separate and shared property and issues of alimony and support.

Without a postnuptial (or prenuptial) the state may divide assets according to the formula established by statute.
