This Extra Agreement is between a producer and an individual who will act as an extra in a motion picture. This agreement sets forth the specific terms of the arrangement including dates of employment, extra’s role, payment of wages and meal break policy. The agreement also sets forth that employment of the extra is subject to him/her providing documents required by IRCA and those required by law to verify immigration employment eligibility requirements. This agreement also contains an Extra Release which must be agreed to and signed by the extra. Having a written agreement to employ an extra in a motion picture is crucial. This Extra Agreement contains the following provisions:
  • Parties/Related Agreement Information: Sets out the name of the producer, the title of the motion picture, the role to be played, dates of employment and employee’s name, address, contact information, social security number and rate of pay per day;
  • Payment of Wages: Extra shall be paid on the Friday following the week in which services are performed. All payments are equitable and inclusive and no further sums shall be payable to the extra by reason of exploitation of the motion picture;
  • Work Time: No increased or additional compensation will be paid for work performed on nights, weekends or holidays unless expressly set forth;
  • Meals: Producer will provide meal breaks or food services at approximate six hour intervals;
  • Requisite Documentation: Extra will provide all documents required by IRCA and comply with all immigration verification procedures required by law;
  • Alcohol or Drugs: Use of alcohol or drugs during employment hours will result in employee’s immediate termination;
  • Screen Credit: Extra’s screen credit is subject to the discretion of the producer;
  • Rights of Use: Producer is the owner of all results and proceeds of extra’s services and has the right to use extra’s name, voice, picture and likeness in connection with the motion picture;
  • Signatures: The employee/extra and producer must both sign and date this agreement;
  • Extra Release: The extra grants all rights in his/her performance in the motion picture to the producer.
