This Fixed Fee Retainer Letter is between a client and an attorney who agrees to represent the client on a fixed fee basis. This letter sets out details of the client's legal matter and how costs (such as court costs, copy fees or court reporter fees) will be paid. It also sets forth that the client gives the attorney a forfeiture lien which will attach to any recovery in the case. It is crucial that this arrangement be clearly set forth in writing. A Fixed Fee Agreement will be beneficial if there are disagreements or miscommunication between the attorney and client regarding the case.

  • Fee: Sets forth the non-refundable retainer which will be paid and the fixed fee for handling the case through its disposition;
  • Costs: Client agrees to pay all costs associated with the lawsuit;
  • Right to Withdraw: Attorney may withdraw from the case if there are personal differences with the client or if client is unable to meet the financial obligations;
