   Both the Lessor and the Lessee should review the agreement carefully before signing.  

   Lessor should describe the property tract as specifically as possible in both the Agreement and in Exhibit A.

   Generally both the Lessor and the Lessee will each retain an original signed Agreement; therefore, at least two original copies of the Agreement should be executed (i.e. signed).

   As further protection for the Lessor, this packet includes a separate Release of Liability and Acknowledgement and Acceptance of Dangers, Risks, and Hazards.

A Hunting Lease is an agreement between a property owner (“Lessor”) and an individual or other entity (“Lessee”) to rent a tract of land for the purpose of hunting.  All hunting rights (or as otherwise limited in the agreement) are transferred to the Lessee for a specified period of time.  This agreement includes provisions to limit the number of hunters, require that the hunters are properly licensed and early termination option in the event of a sale.

This packet also includes a separate Release of Liability and Acknowledgement and Acceptance of Dangers, Risks, and Hazards.
Contracts such as these are governed by state law.  Many of the state laws differ dramatically, therefore the Lessor and Lessee should become familiar with the laws of their specific state before entering into this type of arrangement.  In addition, before using the form you should always consult with your attorney to ensure that it addresses your specific situation.

HUNTING LEASE
 
THIS LEASE AGREEMENT is made and entered into by and between _______________ [name of Lessor] (hereinafter referred to as Lessor”), and ______________ [name of Lessee], of ________ [city], __________ [state] (hereinafter referred to as Lessee”).

Lessor, for and in consideration of the fees, covenants, and agreements to be kept and performed by Lessee, does hereby GRANT AND DEMISE to Lessee hunting rights and privileges in, on, and across that certain tract of land in __________ [county], __________ [state] (hereinafter referred to as the Hunting Lease”) and being more fully described in Exhibit A, which is incorporated herein for all purposes.

I. Term: The term of this Hunting Lease is for a period commencing on ______________________ [date], and ending on _______________________ [date], inclusive of such beginning and ending date and may be extended for additional year or years upon mutual consent of both Lessor and Lessee in writing.

Lessor expressly retains the right to sell the Property charged with and the object of this Hunting Lease, subject only to the rights of Lessee recited herein. In the event Lessor Enters into an agreement to sell all or any part of this property during the term of this Hunting Lease, Lessee will relinquish all rights hereunder. It is expressly understood and agreed unearned rental will be returned to Lessee based on a formula of the number of months consumed versus the number of months remaining in the year such sale occurs.

II. Consideration: Lessee agrees to pay to Lessor a fee of $________ per year. Lessee, as further consideration and inducement for Lessor to grant this Hunting Lease, understands and agrees Lessor may vary the rental, the number and type of game to be taken, the tract size, the type of weapons and permitted hunting methods on the tract based on an annual review of hunting conditions based on recognized wildlife management techniques, such review to be conducted each year on or before _______________________ [date]. Lessee expressly agrees all rental payments shall be paid in full on or before _____________________ [date] of each year at the address listed for Lessor in Section III.

III. Notices: Notices to either Party will be signed by the designated representative of such Party, or their successors in interest or office, and delivered personally or sent by U.S. certified or registered mail, return receipt requested, postage prepaid, addressed as follows:

Notice will be deemed given on the date hand delivered or deposited in the U.S. mail.

IV. Assignment: Lessee has no right to assign or in any manner transfer, this Hunting Lease or any interest without the previous written consent of Lessor. Any such assignment or transfer without such consent is void. Consent by Lessor to one assignment of rights hereunder will not operate to exhaust Lessors rights, nor will such consent void Lessees liability for all fees due and payable or the performance of all other obligations contained in this Hunting Lease.

V. Use: During the term of this hunting lease, the Property may be used by Lessee solely for hunting purposes. Lessee expressly understands and agrees this right and privilege extends only to quail, migratory game birds, and feral hogs which may be found on and harvested from the Property.

The rights and privileges granted are specifically subject to and must be exercised in conjunction with a grazing and agricultural lease from Lessor to ________________ [name], _________________________________________ [address], ______________ [city], ____________ [state], “the grazing and agricultural Lessee” in the exercise of his rights and privileges shall not interfere with the grazing and agricultural Lessees rights to graze or cultivate the Property and agrees to be liable for damages to either the grazing and agricultural Lessees or Lessor, as the case may be, for any harm done by Lessee or Lessees guests to livestock or crops.

Lessee shall have the right of ingress and egress on and over the property subject to the following understandings and limitations. Lessee shall, to the greatest extent possible, use existing roads for vehicular traffic and Lessor further expressly reserves the right to restrict vehicular traffic to a specific route or routes based on surface and weather conditions. To the extent necessary and prudent, off-road travel is limited across improved pastures, crop land, and wet ground to foot or light ATV vehicles in order to protect the rights of the grazing and agricultural Lessee, if any.

Lessee is expressly limited to ___ [number] hunters, having in their possession a valid hunting license along with appropriate “duck” stamps, if required, on the property at any one time. It is expressly understood and agreed Lessee, or his designee, will physically be on the Lease with hunters and guests. Lessee assumes responsibility and liability for the acts of his designee, hunters, and guests while on the Hunting Lease. Lessee shall have each designee, hunter, and guest sign a Release of Liability, Exhibit B, and send such Release to Lessor.

Lessee agrees and understands only weapons appropriate for the type of game being hunted are authorized. Lessee expressly acknowledges and agrees no automatic weapons or target practice are authorized on the Lease.

Lessor acknowledges Lessees right to construct and remove nonpermanent blinds or hunting aids. Such blinds or hunting aids shall not interfere with or impede any grazing or agricultural activity on the property and Lessee expressly acknowledges the right of the grazing and agricultural lessee to request the relocation of such non-permanent blinds or hunting aids which, in the grazing and agricultural lessees opinion, impedes the free exercise of his grazing and agricultural activity.

VI. Care of the Property: Lessee will clean and maintain the Hunting Lease consistent with the practices of a reasonably prudent hunter. Camping is permitted in areas which will not interfere with the rights of the grazing and agricultural Lessee, if any. Lessee expressly agrees to repair road, fence, or gate damage resulting from his use of the Property.

Lessee acknowledges Lessor is concerned that Lessees activities not result in environmental damage to the Property. Lessee covenants and agrees not to engage in any activity on the Property which will result in short or long term damage. Lessee will refrain from activities which will result in spills, leaks, or discharge of fuels, lubricants, oils, garbage, or any other liquid or solid hazardous or polluting substance.

Should Lessee fail to maintain the Property to Lessors satisfaction, Lessor may enter the Property and clean and repair as necessary. In such event such costs will constitute an additional fee payable by Lessee upon demand. Failure to maintain the Property may result in the forfeiture of the rights and privileges under this Hunting Lease.

VII. Examination and Acceptance of the Property: Lessee has fully examined the Hunting Lease and the Property is accepted in its present condition.

VIII. Right of Inspection: Lessor reserves the right to enter the Property at any time for purposes of inspecting and evaluating Lessees use of the lease. It is agreed and understood Lessor may inspect all animals taken or harvested from the property for purposes of collecting information for research and demonstration purposes. Lessor may require Lessee, his designees, hunters, and guests to present to Lessor for inspection, under such terms as Lessor may require, all animals taken or harvested. Lessor reserves the right to remove one wing, crops, animal parts and other scientific samples from inspected game birds and animals. No organs or tissue shall be taken that affect the usefulness of the game birds and animals without Lessees permission. It is expressly understood and agreed Lessor reserves the right to take animals and game birds from the lease for research, such taking is expressly limited in number, frequency, and type as to not interfere with Lessees rights.

IX. Minerals: It is specifically understood Lessor has, at all times, the right to grant permits for seismic surveys and lease the property for oil, gas and mineral exploration. Lessee expressly acknowledges oil, gas and mineral exploration activities may be conducted on the Property in a manner and to the extent the Mineral Lessee and Lessor may agree. Lessor shall have no liability regarding damages of any nature to Lessees hunting rights from activities in furtherance of seismic or oil, gas and mineral exploration.

X. Game Laws and Lease Record: Lessee specifically agrees to comply with all State hunting laws to include, but not limited to, completion of the daily hunting ledger required by ______________________________________ [statute]. As holder of this Hunting Lease, Lessee agrees to cause registration of each hunter in a record book and include in such registration, the following: (i) the name and complete address of each hunter; (ii) the hunting license number of each hunter; (iii) the number and type of game birds killed each day by each hunter.

Lessee acknowledges the failure or refusal of a guest to supply the required information will result in such guest not being allowed to hunt on the Property. The daily hunting ledger will be made available to Lessor or Game Wardens upon request. Lessee agrees not later than ______________ [date] of each year to deliver the record book to a Game Warden in ____________ [county], ______________ [state], with a copy to Lessor.

XI. Waiver: No waiver by Lessor or Lessee of any default or breach of any term, condition, or covenant of this Lease will be a waiver of any other breach of any other term, condition, or covenant.

XII. Indemnification: Lessee agrees to take all reasonable precautions against the occurrence of accidents, injury, or damage to persons, or property on the Hunting Lease.

It is agreed Lessee will defend, indemnify, and hold harmless Lessor, its assigns, employees, and representatives from and against all loss, cost, damage, or expense (including but not limited to attorneys fees and court costs) of every kind and character which Lessor may suffer, incur, sustain, or be liable for (or be alleged to be liable for), in any way, either directly or indirectly, resulting from, connected with, or arising out of the operations of Lessee, irrespective of who may be alleged to be, or is, in fact, responsible. Lessee intends Lessor to be indemnified and held harmless in the broadest manner possible.

Lessee waives all rights of subrogation against Lessor and/or its assigns, employees, and representatives.

XIII. ________________ [State] Law to Apply: This Hunting Lease is construed under and in accordance with the laws of _________________ [state].

XIV. Grammatical Interpretation: Whenever the singular number is used, the same includes the plural, and the masculine gender includes the feminine and neuter gender.

XV. Headings: Headings are for reference and will not be construed to limit or alter the meaning of the provisions of this Agreement.

XVI. Entire Agreement: This Lease constitutes the entire agreement between Lessor and Lessee and will not be explained, modified, or contradicted by any prior or contemporaneous negotiations, representations, or agreements, either written or oral. This Hunting Lease may only be amended by a subsequent written instrument.

XVII. Parties Bound: This Agreement shall be binding upon and inure to the benefit of the Parties to this Agreement and their respective heirs, executors, administrators, legal representatives, successors in interest or office, and assigns (but this Section shall not constitute permission for an assignment).

XVIII. Saving Clause: Should any clause in this Agreement be found invalid by a court of law, the remainder of this Agreement shall not be affected and all other provisions in this Agreement shall remain valid and enforceable to the fullest extent permitted by law.

XIX. Time Limit: If a fully executed copy of this Hunting License has not been returned to Lessor by __________ [time] on _____________ [date], this offer to lease by Lessor shall automatically terminate.

I hereby acknowledge I have knowingly and willingly entered a Hunting Lease and have become a Party bound by the terms and conditions of a Hunting Lease Agreement between Lessor and Lessee, dated __________ [date]. I understand the terms, provisions and conditions of the Hunting Lease Agreement and will abide by its terms, provisions, and conditions.

I further acknowledge and understand no warranty, either expressed or implied, is made by Lessor as to the condition of the Property (referred to herein as the Hunting Lease”) located in __________ [county], __________ [state], or any roads, buildings, gates or other improvements located thereon. This document is sufficient warning dangerous conditions, risks and hazards may exist. My presence and activities on the Hunting Lease expose me and my property to dangerous conditions, risks, and hazards, including but not limited to: poisonous snakes, insects and spiders; blinds and tree stands; erosion and the general condition of the land, both on and off roadways, creating rough, hazardous and dangerous driving and walking conditions; animals both wild and domestic that may be diseased and/or potentially dangerous; and persons with firearms both on or off the Hunting Lease. I hereby expressly assume all such dangers, risks and hazards.

In consideration for the right to enter the Hunting Lease, I hereby release and agree to protect, indemnify and hold harmless Lessor and its respective agents, employees and assigns from and against any and all claims, demands, causes of action and damages, including attorney fees, resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from the use of the Hunting Lease and all improvements thereon, whether or not caused by Lessors negligence or gross negligence. This Release applies during the time I am permitted on the Hunting Lease. I hereby further covenant and agree that I, my heirs, successors and assigns will not make any claim or institute any suit or action at law or in equity against Lessor or its agents, representatives, employees, successors in interest or office, or assigns.

As used in the Release, the terms I, my person and myself include minors in my care while on the Hunting Lease.

Lessee is expressly limited to ___ [number] hunters, having in their possession a valid hunting license along with appropriate “duck” stamps, if required, on the property at any one time. It is expressly understood and agreed Lessee, or his designee, will physically be on the Lease with hunters and guests. Lessee assumes responsibility and liability for the acts of his designee, hunters, and guests while on the Hunting Lease. Lessee shall have each designee, hunter, and guest sign a Release of Liability, Exhibit B, and send such Release to Lessor.

Lessee agrees and understands only weapons appropriate for the type of game being hunted are authorized. Lessee expressly acknowledges and agrees no automatic weapons or target practice are authorized on the Lease.

Lessor acknowledges Lessees right to construct and remove nonpermanent blinds or hunting aids. Such blinds or hunting aids shall not interfere with or impede any grazing or agricultural activity on the property and Lessee expressly acknowledges the right of the grazing and agricultural lessee to request the relocation of such non-permanent blinds or hunting aids which, in the grazing and agricultural lessees opinion, impedes the free exercise of his grazing and agricultural activity.

VI. Care of the Property: Lessee will clean and maintain the Hunting Lease consistent with the practices of a reasonably prudent hunter. Camping is permitted in areas which will not interfere with the rights of the grazing and agricultural Lessee, if any. Lessee expressly agrees to repair road, fence, or gate damage resulting from his use of the Property.

Lessee acknowledges Lessor is concerned that Lessees activities not result in environmental damage to the Property. Lessee covenants and agrees not to engage in any activity on the Property which will result in short or long term damage. Lessee will refrain from activities which will result in spills, leaks, or discharge of fuels, lubricants, oils, garbage, or any other liquid or solid hazardous or polluting substance.

Should Lessee fail to maintain the Property to Lessors satisfaction, Lessor may enter the Property and clean and repair as necessary. In such event such costs will constitute an additional fee payable by Lessee upon demand. Failure to maintain the Property may result in the forfeiture of the rights and privileges under this Hunting Lease.

VII. Examination and Acceptance of the Property: Lessee has fully examined the Hunting Lease and the Property is accepted in its present condition.

VIII. Right of Inspection: Lessor reserves the right to enter the Property at any time for purposes of inspecting and evaluating Lessees use of the lease. It is agreed and understood Lessor may inspect all animals taken or harvested from the property for purposes of collecting information for research and demonstration purposes. Lessor may require Lessee, his designees, hunters, and guests to present to Lessor for inspection, under such terms as Lessor may require, all animals taken or harvested. Lessor reserves the right to remove one wing, crops, animal parts and other scientific samples from inspected game birds and animals. No organs or tissue shall be taken that affect the usefulness of the game birds and animals without Lessees permission. It is expressly understood and agreed Lessor reserves the right to take animals and game birds from the lease for research, such taking is expressly limited in number, frequency, and type as to not interfere with Lessees rights.

IX. Minerals: It is specifically understood Lessor has, at all times, the right to grant permits for seismic surveys and lease the property for oil, gas and mineral exploration. Lessee expressly acknowledges oil, gas and mineral exploration activities may be conducted on the Property in a manner and to the extent the Mineral Lessee and Lessor may agree. Lessor shall have no liability regarding damages of any nature to Lessees hunting rights from activities in furtherance of seismic or oil, gas and mineral exploration.

X. Game Laws and Lease Record: Lessee specifically agrees to comply with all State hunting laws to include, but not limited to, completion of the daily hunting ledger required by ______________________________________ [statute]. As holder of this Hunting Lease, Lessee agrees to cause registration of each hunter in a record book and include in such registration, the following: (i) the name and complete address of each hunter; (ii) the hunting license number of each hunter; (iii) the number and type of game birds killed each day by each hunter.

Lessee acknowledges the failure or refusal of a guest to supply the required information will result in such guest not being allowed to hunt on the Property. The daily hunting ledger will be made available to Lessor or Game Wardens upon request. Lessee agrees not later than ______________ [date] of each year to deliver the record book to a Game Warden in ____________ [county], ______________ [state], with a copy to Lessor.

XI. Waiver: No waiver by Lessor or Lessee of any default or breach of any term, condition, or covenant of this Lease will be a waiver of any other breach of any other term, condition, or covenant.

XII. Indemnification: Lessee agrees to take all reasonable precautions against the occurrence of accidents, injury, or damage to persons, or property on the Hunting Lease.

It is agreed Lessee will defend, indemnify, and hold harmless Lessor, its assigns, employees, and representatives from and against all loss, cost, damage, or expense (including but not limited to attorneys fees and court costs) of every kind and character which Lessor may suffer, incur, sustain, or be liable for (or be alleged to be liable for), in any way, either directly or indirectly, resulting from, connected with, or arising out of the operations of Lessee, irrespective of who may be alleged to be, or is, in fact, responsible. Lessee intends Lessor to be indemnified and held harmless in the broadest manner possible.

Lessee waives all rights of subrogation against Lessor and/or its assigns, employees, and representatives.

XIII. ________________ [State] Law to Apply: This Hunting Lease is construed under and in accordance with the laws of _________________ [state].

XIV. Grammatical Interpretation: Whenever the singular number is used, the same includes the plural, and the masculine gender includes the feminine and neuter gender.

XV. Headings: Headings are for reference and will not be construed to limit or alter the meaning of the provisions of this Agreement.

XVI. Entire Agreement: This Lease constitutes the entire agreement between Lessor and Lessee and will not be explained, modified, or contradicted by any prior or contemporaneous negotiations, representations, or agreements, either written or oral. This Hunting Lease may only be amended by a subsequent written instrument.

XVII. Parties Bound: This Agreement shall be binding upon and inure to the benefit of the Parties to this Agreement and their respective heirs, executors, administrators, legal representatives, successors in interest or office, and assigns (but this Section shall not constitute permission for an assignment).

XVIII. Saving Clause: Should any clause in this Agreement be found invalid by a court of law, the remainder of this Agreement shall not be affected and all other provisions in this Agreement shall remain valid and enforceable to the fullest extent permitted by law.

XIX. Time Limit: If a fully executed copy of this Hunting License has not been returned to Lessor by __________ [time] on _____________ [date], this offer to lease by Lessor shall automatically terminate.

RELEASE OF LIABILITY AND ACKNOWLEDGMENT AND ACCEPTANCE OF DANGERS, RISKS, AND HAZARDS OF HUNTING LEASE
 
I hereby acknowledge I have knowingly and willingly entered a Hunting Lease and have become a Party bound by the terms and conditions of a Hunting Lease Agreement between Lessor and Lessee, dated __________ [date]. I understand the terms, provisions and conditions of the Hunting Lease Agreement and will abide by its terms, provisions, and conditions.

I further acknowledge and understand no warranty, either expressed or implied, is made by Lessor as to the condition of the Property (referred to herein as the Hunting Lease”) located in __________ [county], __________ [state], or any roads, buildings, gates or other improvements located thereon. This document is sufficient warning dangerous conditions, risks and hazards may exist. My presence and activities on the Hunting Lease expose me and my property to dangerous conditions, risks, and hazards, including but not limited to: poisonous snakes, insects and spiders; blinds and tree stands; erosion and the general condition of the land, both on and off roadways, creating rough, hazardous and dangerous driving and walking conditions; animals both wild and domestic that may be diseased and/or potentially dangerous; and persons with firearms both on or off the Hunting Lease. I hereby expressly assume all such dangers, risks and hazards.

In consideration for the right to enter the Hunting Lease, I hereby release and agree to protect, indemnify and hold harmless Lessor and its respective agents, employees and assigns from and against any and all claims, demands, causes of action and damages, including attorney fees, resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from the use of the Hunting Lease and all improvements thereon, whether or not caused by Lessors negligence or gross negligence. This Release applies during the time I am permitted on the Hunting Lease. I hereby further covenant and agree that I, my heirs, successors and assigns will not make any claim or institute any suit or action at law or in equity against Lessor or its agents, representatives, employees, successors in interest or office, or assigns.

As used in the Release, the terms I, my person and myself include minors in my care while on the Hunting Lease.
