Notice to Quit for Nonpayment of Rent or Other Breach
If it becomes necessary for a Landlord to notify a Tenant that they need to vacate certain leased premises due to non-payment of rent or due to some other breach, the notice should be in writing. This is not only a good idea, but it also often required by law and/or by the lease.
This is a written notice from a Landlord to a Tenant who has failed to comply with an obligation under the lease or term of the lease. Some of the possible breaches under a lease may include (a) tenant failed to make rent payments; (b) tenant made alterations without permission; (c) tenant refuses to allow the landlord access to the rental unit after reasonable notice; (d) tenant is severely disturbing other tenants or seriously damaging the property; (e) tenant conducts serious illegal activity on the rental property, etc….
This type of notice is sometimes called a "Notice to Quit". This notice can be used with either a commercial or residential tenant. Usually, a notice to the tenant that rent is overdue (or that another obligation under the lease is not met) is sent before the Notice To Quit is sent out. When the tenant fails to respond to the notice (i.e. that rent is overdue), it is customary to then send out a Notice To Quit.
