General Information
Security Deposit Demand Letter

When you rented your residence, chances are that you provided a security deposit.  This is money used to secure the performance of a lease. The deposit may be retained by the landlord for, among other things, any unpaid rent or utility bills owed by the tenant, payment for damages beyond normal wear and tear, any cleaning the tenant agreed to in the lease.

If you, as the tenant, have fulfilled all of your obligations under the leasehave paid the rent in full and on time, have left no financial obligation to the landlord, and have caused no damage beyond ordinary wear and tear, you are entitled to a full return of the security deposit.  Most state laws require that the landlord return the security deposit or send an itemized statement of the deductions and the balance of the deposit, if any, to the tenant within thirty days after termination of the tenancy or risk forfeiting any right to the security deposit.

But what happens if the landlord doesnt return your security deposit or send an accounting?  The first thing you should do is send a letter requesting that he/she do just thatreturn your deposit.  And if the landlord has missed the state imposed time limit for returning your deposit or sending an accounting, you can and should demand that the entire security deposit be returned to you.

If the landlord fails to comply with this request, the next step may be taking him/her to court.
